Sukoharjo – Media sosial dalam beberapa hari terakhir sempat dihebohkan dengan sebuah penilangan kepada seorang pengendara motor di wilayah Kabupaten Sukoharjo. Pasalnya, foto surat konfirmasi tilang kamera atau Electronic Traffic Law Enforcement (E-TLE) tersebut memperlihatkan seorang pengendara motor tanpa helm dengan latarbelakang persawahan.
Menanggapi kejadian tersebut, Kapolres Sukoharjo AKBP Wahyu Nugroho Setyawan, meminta maaf kepada publik, jika penilangan yang terjadi justru membuat ketidaknyamanan di dunia maya.
Kapolres menjelaskan, terkait bagaimana penilangan bisa terjadi, Dia menyebut jika yang bersangkutan tertangkap melakukan pelanggaran melalui E-TLE Mobile, bukan dari E-TLE yang biasanya terpasang di ruas jalur protokol.
“Jadi bukan kamera E-TLE nya diletakkan di persawahan. Tapi memang anggota kita diberi aplikasi khusus di handphonenya untuk memantau pelanggaran sambil berpatroli. Itulah yang namanya E-TLE Mobile,” ungkapnya.
AKBP Wahyu juga menambahkan, bahwa yang bersangkutan (pria yang tertilang) sudah menemui petugas Satlantas Polres Sukoharjo, untuk mengakui pelanggaran yang telah dilakukannya dan membayar denda tilang melalui sistem BRIVA yang telah ditentukan.
“Sudah dikonfirmasi. Yang bersangkutan juga mengakui kesalahannya. Ia mengaku waktu tertangkap E-TLE itu sedang kembali dari takziah,” jelasnya.
Sementara itu, Kapolres menyampaikan bahwa tingginya data fatalitas akibat kecelakaan di Sukoharjo, menjadi alasan penindakan pelanggaran lalu lintas perlu ditingkatkan. Selain itu, lanjut dia, tidak ada Undang-Undang yang mengatur bahwa pengendara bermotor boleh tidak menggunakan helm di ruas jalan tertentu.
Secara yuridis dijelaskan, bahwa Pasal 291 ayat 2 merupakan aturan yang merujuk pada kedisiplinan setiap pengendara motor dalam menggunakan alat keselamatan saat berkendara. Jika ada penumpang yang melanggar aturan ini, tentu saja bisa kena tilang bahkan ditindak pidana sesuai pasal yang berlaku.
Hal tersebut sudah tertuang dalam UU No.22 thn 2009 Tentang Lalu Lintas dan Angkutan Jalan, yang menyebut bagi pengendara yang tidak sesuai aturan alias melanggar bisa kena denda hingga kurungan.
“Setiap pengemudi yang membiarkan penumpangnya yang tidak memakai helm sebagaimana dimaksud dalam Pasal 106 ayat (8), dipidana dengan pidana kurungan paling lama 1 (satu) bulan atau denda paling banyak Rp 250 ribu,” jelas AKBP Wahyu menuturkan bunyi Pasal 291 ayat 2.
Kapolres menambahkan, jika di Sukoharjo meskipun wilayahnya persawahan, tingkat kecelakaannya cukup tinggi. Dimana sepanjang tahun 2021 ada 21 kejadian kecelakaan dengan enam orang dilaporkan meninggal dunia. Sementara untuk tahun 2022, sejauh ini sudah ada 10 kejadian dengan tiga orang dilaporkan meninggal dunia.
